The law around making a holiday claim has changed and more holidaymakers could now be entitled to receive compensation.

In July, the Package Travel and Linked Travel Arrangements 2018 came into effect. This has amended the rules around what makes up a package holiday sold in the UK. As a result, more people could be entitled to bring a claim against their tour operator.

What are the Package Travel Arrangements 2018?

Under the Package Travel Arrangements 2018, you have a legal right to expect the holiday you booked and paid for to match the description given.

If the holiday doesnt match the description, you can ask your tour operator to put it right under the Package Travel Arrangements 2018. If your tour operators fails to do this, you can bring a claim for compensation.

Is your holiday a package?

You can only make a claim for compensation if your holiday is booked as a package. Your holiday will most likely be a package if:

  • It was advertised as a package or all-inclusive deal
  • You bought the holiday for an inclusive or total price
  • You bought more than one part of your holiday from one company with one payment

If your holiday looked like a package, it most likely will be protected by the Package Travel Arrangements 2018.

How to make a package holiday compensation claim

If you have suffered an illness or injuries caused by an accident on a package holiday, you could be entitled to receive compensation.

If the illness or injury is caused by your hotel, or on a trip or transport organised by your tour operator, you could be entitled to make a claim.

For example, if your illness is caused by undercooked food or poor food hygiene at your hotel, your tour operator could be responsible.

This means that you can bring your claim against your tour operator right here in the UK.

When making a claim under the Package Travel Arrangements 2018, your compensation will include:

  • Compensation for any loss of value for your holiday (e.g. days missed due to an illness or injury).
  • Compensation for the pain and suffering caused by your illness or injury.
  • Any expenses you have incurred due to your illness or injury such as travel or medical costs.
