Your Holiday Claims, a division of Farnworth Rose Solicitors, is now dealing with a group of 45 holidaymakers whose holidays were ruined by food poisoning at the Iberostar Chich Khan in August 2013.
Those suffering illness have experienced symptoms of severe stomach cramps and diarrhoea, fever, nausea, and vomiting. On return to the UK a number of holidaymakers went to their GP for treatment and provided stool samples which proved positive for the bacterial infections salmonella and shigella.
Those clients who have already instructed us to seek compensation from their tour companies have reported many problems with food and hygiene standards generally, all of which can cause sickness amongst residents at any holiday hotel.
Anne Thomson, Head of Travel Law at Your Holiday Claims, is very concerned: âIt is absolutely clear that there were serious problems at the Chich Khan last summer, certainly during August. My clients have reported undercooked food, particularly chicken, which is a disaster waiting to happen. Food which should have been served hot was lukewarm and flies were seen in the restaurant buffet area and on the uncovered food. All these issues are well known for causing food poisoning at the Iberostar Chich Khan. It has been heart breaking to hear of the family holidays that have been ruined.
âWhat also concerns me is the way in which some tour companies are trying to avoid paying compensation to their customers. One tour operator told a customer, Hotels we use only have to comply with local standards and there is no evidence to suggest that this was the case here. I doubt that local standards would support flies on the food or chicken being undercooked! If anyone has attempted to claim compensation but have been put off by such an argument, I would urge them to contact me for further advice and assistance.â
Well-known and trusted tour companies who sent customers to the Iberostar Chich Khan during summer 2013 include Thomas Cook, Medhotels, and Lowcost Holidays.
We can help you make a claim for compensation
If you have suffered food poisoning at the Iberostar Chich Khan, the team at Your Holidays Claims is available to help you. Our specialist team of travel lawyers has over 50 years combined experience successfully dealing with holiday illness and accident claims.
The Package Travel Regulations 1992 extend your tour operators liability â your tour operator has to accept responsibility for any faults and failings on the part of the hotel.
