It has come to our attention that First Choice is contacting holidaymakers who have been ill during their stays at Club Mac Alcudia in Majorca.

The company is making offers of compensation for the spoilt holidays but it appears that not all offers are being fairly and properly assessed. Some holidaymakers will see themselves totally undercompensated.

Anne Thomson, Head of Travel Law at Your Holiday Claims, a division of Farnworth Rose solcitors, comments: “First Choice clearly recognises that there has been a serious problem at Club Mac Alcudia and it is making efforts to compensate its customers. This, in itself, is good news for the customer but I am extremely concerned that many holidaymakers will accept offers to settle without realising that they are being undercompensated.

“Some holidaymakers are receiving a refund of their holiday cost but, in many cases, this will not represent fair compensation. A person who has been ill is entitled to claim for pain and suffering, the lost days of the holiday/loss of enjoyment of the holiday and can also claim reimbursement of any out of pocket expenses incurred.

“Many people who have just returned from Club Mac have not yet fully recovered from their illnesses and it is impossible for First Choice to fairly assess the correct level of compensation a person is entitled to.

“If anyone has received a call from First Choice or any other tour operator making an offer to settle, I would urge them to contact us for advice before accepting any figure put forward. It may be that the offer is reasonable but I anticipate that, in many cases, the offer would be far too low.
