Accident Abroad Claims Advice
An accident abroad can result in costly out-of-pocket medical expenses, stress dealing with travel insurance documents, and difficulty overcoming language barriers. This can lead to many days of a holiday being lost and can often completely ruin the holiday that you have worked hard for.
Many people are still unaware of where to turn after suffering from an accident abroad. UK law does however entitle you to make a claim for compensation against the tour operator on your return to the UK, when you have suffered injuries in a package holiday hotel through no fault of your own.
At Your Holiday Claims we offer an expert, personable service, working on your behalf to manage your claim whilst keeping you informed of any progress and explaining all of the steps involved. We aim to always be on hand to offer advice and guidance on any aspect of your claim and we will work tirelessly to recover the compensation that you deserve.
We understand that when you have suffered a holiday accident you can be left with many questions on how you could make a claim for compensation and what your next steps should be. Here we answer some of the most common questions relating to holiday accident claims.
Can I make a claim even if I did not have travel insurance?
You may still be able to make a claim for compensation regardless of whether you had travel insurance at the time of the accident.
If you have been involved in a package holiday accident that has occurred as a result of negligence by a third party, you could still have grounds to make a successful claim for compensation.
How long do I have to make a holiday accident claim?
You are entitled to pursue a holiday accident claim within three years of the accident date. However, we encourage all of our clients to proceed with their claim as soon after the accident as possible, when the details of the accident or injury are still fresh in their minds.
As with most personal injury cases, proving liability is vital in any holiday accident claim, so obtaining sufficient evidence is vital to support your claim. In most cases, this is much easier soon after the accident.
Medical evidence, including receipts of any prescription drugs or treatment from your GP and details of any other medical professionals visited in relation to your injury will help to build a strong case.
Witness statements and video or photographic evidence can also aid your solicitor in proving negligence.
Are there any costs involved in making a holiday accident claim?
At Your Holiday Claims, our experienced team holiday claims specialists represent all clients on a no win no fee basis.
No win no fee entitles you to make a claim for compensation without the risk of being left out of pocket in the unlikely event that your claim is unsuccessful.
We recommend that all of our clients take out After the Event Insurance (ATE) for their benefit and protection. This insurance is only payable if your claim is successful. If your claim is unsuccessful, you won’t have to pay a penny to anyone.
