Can I make a claim even if I did not have travel insurance?
You may still be able to make a claim for compensation regardless of whether you had travel insurance at the time of the accident. Does my holiday have to booked as part of a package?
Yes, in order to make a claim for holiday accident compensation your holiday will need to have been booked as part of a package.
When you travel on a package holiday, you are protected by the Package Travel Regulations 1992. These regulations allow you make a claim against your tour operator right here in the UK if you have suffered injuries caused by accident that wasn’t your fault either at the hotel or during any transport and excursions organised by your tour operator. How long do I have to make a claim for an accident abroad?
You are entitled to pursue a holiday accident claim within three years of the accident date. However, we encourage all of our clients to proceed with their claim as soon after the accident as possible, when the details of the accident or injury are still fresh in their minds. As with most personal injury cases, proving liability is vital in any holiday accident claim, so obtaining sufficient evidence is vital to support your claim. In most cases, this is much easier soon after the accident.
Medical evidence, including receipts of any prescription drugs or treatment from your GP and details of any other medical professionals visited in relation to your injury will help to build a strong case. Witness statements and video or photographic evidence can also aid your solicitor in proving negligence.
Are there any costs involved in making an accident abroad claim?
