I did not travel on a package holiday as I booked flights and hotel separately. Can I still file for a holiday illness claim?
In accordance with the Package Travel Arrangements 2018, the experts at YourHolidayClaims routinely assist holidaymakers in pursuing claims which were booked as a package holiday.
Unfortunately, if your holiday was not booked as part of a package, it is unlikely that you will be able to make a claim for compensation.
Our experts are able to assess your booking documentation to help you find out if your holiday is protected by the regulations and are readily available to advise as to whether you may be able to receive compensation.
How do I know if my holiday was booked as a package?
Your holiday will most likely be a package if:
- It was advertised as a package or all-inclusive deal
- You bought the holiday for an inclusive or total price
- You bought more than one part of your holiday from one company with one payment
If your holiday looked like a package, you will most likely be covered by the Package Travel Arrangements 2018.
You can find out more about the Package Travel Arrangements here.
Does my holiday package need to be all-inclusive?
In most cases, you can only pursue a holiday claim if your holiday was booked on an all-inclusive basis.
In addition, you must be able to demonstrate that you ate exclusively within the resort.

I was ill on holiday but did not report it or seek medical attention, is it still possible to claim for holiday sickness compensation?
The experts at YourHolidayClaims would always recommend that you report your illness at the resort to your Tour Representative and to seek medical assistance in relation to your symptoms either in resort or upon your return to the UK.

Yes. If a claim is being made on behalf of a child under the age of 18, an adult will need to act on his/her behalf.
In relation to time limits, any claim on behalf of a child must be commenced within 3 years of their 18th Birthday, i.e. before their 21st Birthday.
How long does the holiday illness claim process take?
The time it takes to make a claim will vary depending on how complex the case is, the seriousness of your illness and how quickly your tour operator responds. The experts at YourHolidayClaims shall guide you through the process and can advise at various stages throughout as to likely timescales involved.
